Hands, Paws & Hearts in consideration of the mutual covenants in this Agreement and other good and valuable consideration, intending to be legally bound by this Agreement, agrees to the following: You understand that this Dog was previously unwanted or lost and may have been rescued by us from a dangerous, unhealthy and/or cruel situation. This could have long-lasting effects on the Dog. You agree that we are making no representations or warranties about the conditions, personality or temperament of the Dog. Rescue cannot guarantee the health of any animal and shall not be held responsible for any medical expenses which may be incurred, hereby expressly excluding any implied or express warranties of merchantability or fitness for any particular purpose, including without limitation any warranties regarding health, temperament or whether the animal is housebroken. Foster agrees to not cosmetically alter the animal unnecessarily in any way, including but not limited to the declawing of cats, the docking of tails, and the cropping of ears. You agree to provide the Dog with fresh water, wholesome dog food, adequate outdoor exercise and affection, and shelter. You will walk the Dog on a leash and collar/harness (leash shall not be attached to ID tag collar), or place the Dog in a protected run or other enclosed outdoor area, and NEVER allow the Dog to roam free unsupervised, unless you have an underground electric fence containment system. You will treat the Dog as a household pet, companion and family member and not leave the Dog chained, crated and/or otherwise confined for extended periods of time.

You agree to NEVER leave the dog home alone overnight while you are out of town. The dog will either be boarded in a license facility or boarded with the rescue.

You agree to walk dog on leash at ALL times and he/she must be walked on a harness, soft fabric slip collar, or choke chain. Walking your dog on ID collar puts the dog in unnecessary danger.

You agree to never use the Dog for dog fighting or any other sport in which one animal is pitted against another, to never beat or taunt the Dog in order to promote aggressive ֿguard dog׃ characteristics, and to never use the Dog to facilitate hunting, whether as a retriever, chase animal or companion engaged in such activity.

Foster agrees that Rescue has the right to investigate the home and care of the animal at any time. If, in the opinion of investigators, the pet is not receiving adequate and proper care, feeding, shelter and/or medical attention, or if there is or has been any evidence of cruelty or neglect or failure to observe all prevailing animal ordinances or an anti-cruelty law, Rescue has the right to reclaim the animal immediately.

You agree to contact rescue immediately and make a serious effort to find the Dog if it becomes lost, by immediately (a) filing lost reports with the local police, animal control authorities, animal shelters, SPCAּs and local veterinarians & pet stores, (b) posting lost dog signs (c) running lost dog adds in your local paper and (d) contacting us for additional advice. In addition you agree to notify the Rescue IMMEDIATELY!

You agree that the Dog will always wear an identification tag with your current address and at least two telephone numbers. You also agree to keep the Rescue tag on the collar as back-up to your personalized tag.

You agree to notify the rescue immediately if your address changes or telephone information.

You agree to return the dog to the rescue immediately should you decide you are no longer able or want to care for the dog. You cannot give dog away to anyone else but Hands, Paws & Hearts.

You agree that this dog is the property of the Rescue and you are the foster family. As such, the Rescue has the right to re-claim dog at any time. You agree to immediately return dog to Rescue upon Rescue’s request

In the event that you do not comply with the terms of this Agreement, or the Dog is abused or neglected, one of our remedies will be to recover the Dog from you upon demand. Promptly after the demand we will come to your residence and you will surrender the Dog to us immediately. In addition, without waiving any of our rights under this Agreement, if you do not surrender the Dog to us, you will owe us a payment in the amount of $2,500.00 agreed between us as just and reasonable liquidated damages to compensate us for our costs and expenses in connection with your breach of this Agreement and we reserve our rights to reacquire the Dog.

The Rescue is not liable for any claims, legal actions, losses, injuries, damages, costs, expenses or liabilities whatsoever in connection with your adoption or ownership of the Dog. You agree to read and sign the attached Voluntary Release / Waiver of Liability concurrently with your execution of this Agreement.

This Agreement (including the attached Voluntary Release/Waiver of Liability) is the entire agreement between you and us, and supersedes any prior understandings between you and us with respect to the subject matter of this Agreement. No modification of this Agreement will be valid unless in writing dully signed by both you and us. This Agreement is binding upon your and our heirs, assigns, successors, personal representatives and executors. I, the foster, have read and understand this agreement and certify I will confirm to its terms and conditions. I also understand that this animal remains the property of Rescue. I further agree to pay any and all court costs including legal fees which Rescue may incur as a result of my breach of this contract.
